main hearing on charges of membership in a domestic terrorist organization is opened

By decision of March 22, 2024, the 8th Senate for Criminal Matters (State Security Senate [Staatsschutzsenat]) of the Higher Regional Court (OLG) Frankfurt/Main admitted the indictment filed by the Federal Public Prosecutor General (Generalbundesanwalt) against nine defendants and ordered the opening of the main hearing. The trial will begin on May 21, 2024 at 9:30 a.m. Information for media representatives will be published in a separate press release.
With indictment dated December 8, 2023, the Federal Public Prosecutor General accused the defendants of having been members of a terrorist organization or having supported it. The defendants Heinrich XIII P.R. and Rüdiger v.P. are alleged to have acted as ringleaders.
According to the indictment, the organization aimed to violently eliminate the existing state order in Germany and to replace it with its own form of government, the outlines of which had already been worked out.
The members of the organization allegedly shared a deep aversion to German state institutions and to the democratic basic order. They were following a jumble of conspiracy myths consisting inter alia of narratives of the so-called Reichsbürger- and self-administration scene and the QAnon ideology. They were allegedly firmly convinced, members of the so-called “Deep State” governed Germany. Liberation, so the members thought, was promised by the so-called “Alliance”, a - actually non-existent - technically superior secret alliance of governments, intelligence services and military forces from various countries.
According to the indictment, the organization had been planning and preparing to overthrow the German government since August 2021. For this purpose, the organization propagated cooperation with the “Alliance”. It was planned that the “Alliance” would give a signal for the so-called "Day X" to occur whereupon the organization was to intervene. The organization had a cabinet-like council and a military wing. It had funds at its disposal amounting to 500,000 €. It also had access to massive armory.
The proceedings are being conducted against nine defendants after one of the accused deceased recently.
The Senate will hold the main hearing consisting of five judges including the presiding judge.
