The 8th Senate (State Security Senate, Staatsschutzsenat) of the Higher Regional Court (OLG) Frankfurt/Main has admitted the charges brought by the Frankfurt/Main Public Prosecutor's Office against the 29-year-old Fatiha B. for membership in two terrorist organizations abroad (Jabhat al-Nusra and "IS") and for violation of the duty of care and upbringing, and has opened the main proceedings. The Senate will be composed of three judges, including the chairman. The dates of the main hearing will be announced separately.
According to the indictment dated 18 August 2022, the defendant is accused of having moved in the Salafist scene in the Rhine-Main region in 2013. Together with her husband, who is also said to have espoused a radical interpretation of Islam, she is said to have left for Syria via Turkey in September 2013. She is said to have initially joined the terrorist organization Jabhat al-Nusra as a member. In the territory of Jabhat al-Nusra, she is said to have taken care of the joint household and of their daughter, who was born in February 2014.
This is said to have enabled her husband to become a fighter for the organization.
In summer 2014, the couple allegedly left Syria with their daughter and stayed in Turkey, initially with the aim of returning to Germany. In November 2014, they allegedly traveled to the territory of the so-called Islamic State ("IS") and joined this terrorist organization as members.
In the following years, the defendant allegedly followed her husband, who had joined the "IS" as a fighter after military training and was active in its financial administration, to his respective places of operation and enabled his activity for the "IS" by managing the household.
After the defendant was arrested in February 2019 by units of the Kurdish People's Unification, she was held in a Kurdish prison camp together with her daughter and her other children until March 2022. After her repatriation to Germany, she was arrested at Frankfurt Airport on 31 March 2022. She has been in pre-trial detention since then.
The Senate has upheld the arrest warrant.
